BackgroundFor many decades, the debate on children’s competence to give informed consent in medical settings concentrated on ethical and legal aspects, with little empirical underpinnings. Recently, data from empirical research became available to advance the discussion. It was shown that children’s competence to consent to clinical research could be accurately assessed by the modified MacArthur Competence Assessment Tool for Clinical Research. Age limits for children to be deemed competent to decide on research participation have been studied: generally children of 11.2 (...) years and above were decision-making competent, while children of 9.6 years and younger were not. Age was pointed out to be the key determining factor in children’s competence. In this article we reflect on policy implications of these findings, considering legal, ethical, developmental and clinical perspectives.DiscussionAlthough assessment of children’s competence has a normative character, ethics, law and clinical practice can benefit from research data. The findings may help to do justice to the capacities children possess and challenges they may face when deciding about treatment and research options. We discuss advantages and drawbacks of standardized competence assessment in children on a case-by-case basis compared to application of a fixed age limit, and conclude that a selective implementation of case-by-case competence assessment in specific populations is preferable. We recommend the implementation of age limits based on empirical evidence. Furthermore, we elaborate on a suitable model for informed consent involving children and parents that would do justice to developmental aspects of children and the specific characteristics of the parent-child dyad.SummaryPrevious research outcomes showed that children’s medical decision-making capacities could be operationalized into a standardized assessment instrument. Recommendations for policies include a dual consent procedure, including both child as well as parents, for children from the age of 12 until they reach majority. For children between 10 and 12 years of age, and in case of children older than 12 years in special research populations of mentally compromised patients, we suggest a case-by-case assessment of children’s competence to consent. Since such a dual consent procedure is fundamentally different from a procedure of parental permission and child assent, and would imply a considerable shift regarding some current legislations, practical implications are elaborated. For decades, the discussion on children’s competence to consent to medical issues has concentrated around normative concerns, with little progress in clinical practices. Decision-making competence is an important condition in the informed consent model. In pediatrics, clinicians need to strike a proper balance in order to both protect children’s interests when they are not fully able to do so themselves and to respect their autonomy when they are. Although law is established on a strong presumption that persons younger than a certain age are not competent to consent, statutory age limits for asking children’s consent to clinical research differ widely internationally. From a clinical perspective, competence is assumed to involve many factors including the developmental stage, the influence of parents and peers, and life experience. We examined potential determining factors for children’s competence to consent to clinical research and to what extent they explain the variation in competence judgments.

BackgroundCancer patients often suffer from psychological distress during or after cancer treatment, but the use of psycho-oncological care among cancer patients is limited. One of the reasons might be that the way psycho-oncological care is organized, does not fit patients’ preferences. This study aimed to obtain detailed insight into cancer patients’ preferences regarding the organization of psycho-oncological care.Methods18 semi-structured interviews were conducted among cancer patients. Patients completed psycho-oncological treatment between 2015 and 2020 at the psychology department in a general hospital (...) or a center specialized in psychological cancer care in the Netherlands. The interview comprised questions related to preferences regarding the institute where to receive treatment, the psychologist who provides treatment, and the type of treatment, as well as questions related to experienced barriers and facilitators to receive psycho-oncological care. Interviews were digitally recorded and transcribed verbatim. Data were analyzed individually by two coders into key issues and themes.ResultsRegarding the institute, easy accessibility and prompt availability of psychol-oncological care were considered important. Regarding the psychologist, most participants had a strong preference to be treated by a psychologist specialized in cancer or other somatic diseases. Individual face-to-face therapy was preferred above other types of treatment. Several barriers were mentioned to receive psycho-oncological treatment, among which poor accessibility to psycho-oncological care, lack of knowledge on the possibilities for psycho-oncological treatment, and stigma. Most frequently mentioned facilitators were being assertive to ask for help, having a good relationship with the healthcare professional, and the integration of psycho-oncological support within medical cancer care.ConclusionFrom the patient’s perspective, the organization of psycho-oncological care for cancer patients should focus on easy accessibility and availability, delivered by specialized psychologists, and integration in medical cancer care. Online and group therapy are acceptable, but individual face-to-face therapy is preferred. It is warranted to increase awareness on psycho-oncological care targeting both patients and healthcare providers. (shrink)

In the paper we obtain a new characterization of the BCK-algebras which are subdirect product of BCK-chains. We give an axiomatic algebraizable extension of the BCK-calculus, by means of a recursively enumerable set of axioms, such that its equivalent algebraic semantics is definitionally equivalent to the quasivariety of BCK-algebras generated by the BCK-chains. We propose the concept of "linearization of a system" and we give some examples.

In this paper a definition of n-valued system in the context of the algebraizable logics is proposed. We define and study the variety V3, showing that it is definitionally equivalent to the equivalent quasivariety semantics for the “Three-valued BCK-logic”. As a consequence we find an axiomatic definition of the above system.

In this paper we consider twelve classical laws of negation and study their relations in the context of BCK-algebras. A classification of the laws of negation is established and some characterizations are obtained. For example, using the concept of translation we obtain some characterizations of Hilbert algebras and commutative BCK-algebras with minimum. As a consequence we obtain a theorem relating those algebras to Boolean algebras.

In this paper an algebraic version for temporal algebras of the logical filtrations for modal and temporal logics is analysed. A structure theorem for free temporal algebras and also some results with regard to the variety of temporal algebras are obtained.

The aim of this study was to implement the teaching personal and social responsibility model in a competitive context analyzing the differences between the intervention and the control group on personal and social responsibility, prosocial behaviors, and self-efficacy in youth soccer players. Participants were 34 youth soccer players between the ages of 14 and 16 years old divided into two different soccer teams of 17 members, corresponding to the control and intervention groups. The implementation of the TPSR model took place (...) during 9 months, including initial and ongoing coach training, program implementation, and a series of expert-led seminars for athletes. The questionnaires used to collect data were the Personal and Social Responsibility Questionnaire, Prosocial Behavior Scale, and two Children’s Self-efficacy Scales. Results indicated that the TPSR intervention group obtained an increase in post-test levels of personal and social responsibility, prosocial behavior, and self-efficacy due to the application of the TPSR model compared with control group that used a conventional sport teaching methodology. The conclusion is that the TPSR model has the potential to be adapted and implemented with flexibility in youth sport competition contexts in order to improve personal and social responsibility, prosocial behavior, and self-efficacy. Dalyvavimas migraciniuose procesuose per tėvų, artimųjų arba asmenines patirtis formavo asmeninio gyvenimo lūkesčius ir elgseną, keliančius visuomenės nerimą dėl jaunų žmonių išvykimo iš Lietuvos ir šeiminių ryšių transformacijos mobilumo sąlygomis. Pasitelkiant Carol Smart (2007) asmeninio gyvenimo koncepcijoje pasiūlytas teorines (...) idėjas apie socialinės aplinkos, kasdienių praktikų ir asmeninių projektų sąryšį, straipsnyje analizuojama, kaip globali migracija formuoja 1980–2000 m. gimusių ir nepriklausomoje Lietuvoje augusių asmenų migracinius ketinimus, susisaistymo su Lietuva ir šeiminio gyvenimo vaizdinius. Remiantis dviejų Lietuvos gyventojų reprezentatyvių apklausų bei migracinės patirties turinčių asmenų kvotinės apklausos duomenimis, surinktais įgyvendinant Lietuvos mokslo tarybos (LMT) finansuotus mokslininkų grupių projektus, statistinės analizės rezultatais, autorės nagrinėja, kaip jaunimas kuria ateities planus, kokia dalis jų svarsto išvykti iš šalies, kaip migracinės praktikos koreguoja šeiminio gyvenimo įsivaizdavimą. Straipsnyje atskleidžiama, kaip nepriklausomybės laikotarpiu susiformavusi atvira visuomenė ir mobili socialinė aplinka sukūrė prielaidas lanksčiam susisaistymui su savo kilmės šalimi ir savitam jaunų žmonių supratimui apie šeiminį gyvenimą. En este artículo, y desde la sociología del trabajo, argumentamos que los recurrentes antagonismos entre sectores que defienden el medioambiente y los que defienden las fuentes de trabajo son una ficción política. Ello lo sustentamos en una reflexión ontológica-epistemológica desde donde se develan un encadenamiento de jerarquías, desigualdades, dominación y explotación, consagrado en la moderna ideología del desarrollo y progreso ilimitado, bajo cuyo eje se plantea una ficticia comunión de intereses en la que trabajo y capital comparten iguales anhelos de (...) progreso y éxito. Una ficción que resulta ser una estrategia política-ideológica que configura a las/os defensores del medioambiente como antagónicos al desarrollo y creación de fuentes de trabajo, tal como se revela en la industria del salmón del sur de Chile, abordada aquí como un caso “testigo”. Esta estrategia política adquiere pleno sentido en países como Chile, donde hoy se observa un doble y creciente proceso de “precarización de la naturaleza” y “naturalización de la precariedad laboral”. Un factor que engrandece la desmesurada crisis económica que atravesamos es el desempleo masivo que afecta a todos los países industrializados. En una sociedad que enarbola la bandera de los derechos humanos, la falta de empleo resulta inquietante al ser fuente, no sólo de problemas económicos, sino también de tensiones, contradicciones y conflictos que se reflejan en un profundo malestar psicológico.

A través de estas páginas proponemos una breve reflexión sobre el miedo que está generando esta crisis que, en los últimos años, caracteriza la economía de nuestro país y que atañe a la mayoría de los ciudadanos. Pare ello partimos de tres premisas fundamentales que iremos desglosando, para terminar presentando algunas soluciones que pueden ser factibles para hacerle frente.

La matriz del problema de la demarcación se instala en la función misma de la filosofía de la ciencia, sin embargo, su contenido puede ser aplicado al ámbito de las teorías sociales. En este sentido, el siguiente paper tiene el cometido de analizar a partir del libro del 2015 de Judith Butler «Notes Toward a Performative Theory of Assembly», como en el campo de los social el problema de la demarcación produce la distinción entre aquellos que pueden ser considerados como (...) humanos y dignes de la posesión de los derechos básicos de aquellos que no. En consecuencia, en primer lugar, se indicará el itinerario teórico dentro de la obra de Karl Popper del problema de la demarcación y como su aplicación puede ocupar los ámbitos de lo práctico y lo político. En segundo lugar, mostrar cómo se puede aplicar el problema de la demarcación en los planteos de Judith Butler, tanto en el sentido de una formación legítima de la subjetividad humana, como dentro del campo de lo colectivo. En tercer lugar, mostrar cómo en el espacio público asambleario se da una respuesta ético-política a la separación que produce la demarcación entre sujetos precarizados y sujetos dignos de derechos. Finalmente, reflexionar y ofrecer algunas conclusiones. (shrink)

Social theory has paid little attention to air, despite its centrality to bodily existence and air pollution being named the world’s biggest public health crisis. Where attention to air is found, the body is largely absent. On the other hand, conceptualizing the body without life-sustaining breath fails to highlight breathing as the ongoing metabolic bodily act in which the materiality of human and more-than-human intermingle and transmute one another. Political ecology studies how unequal power structures and knowledge production reproduce human–environment (...) relations, including a nascent focus on the body and air – but as separate issues. This article argues that a political ecology of air would productively fuse with a political ecology of the body to bring the visceral realm into intersectional analysis of air’s contemporary materialities. A feminist political ecology situates explicitly air-and-breathing-bodies, their intimately posthuman, relational, elemental and corpomaterial intra-action, at the heart of such analysis. (shrink)

La relación médico-paciente (RMP) es una relación profesional-interpersonal base para la gestión de la salud. Nuestro objetivo fue desarrollar un instrumento que permitiera evaluar la presencia de los principios bioéticos en la atención médica recibida en la consulta externa de una institución hospitalaria. Las feministas han reconocido la importancia de defender la capacidad de pensar de las mujeres y de pensarse a sí mismas; es necesario ir más allá: sólo logramos devolver el respeto a las dominadas duraderas producidas por el machismo patriarcal en el que aún vivimos, al establecer que su facultad de juzgar radica en el uso del diálogo que comparte con los hombres, además de su diferencia de sexo y que sólo podemos disipar todas las presuntas dudas planteadas por violadores (...) e intelectuales que se han mantenido machistas respecto a su facultad femenina de juzgar mostrando su origen en una segunda naturaleza común del lenguaje así como su eficacia. Este estudo teve por objetivo conhecer a experiência de mulheres brasileiras e francesasmães de meninas com idade entre três semanas e 11 meses. A perspectiva epistemológica foi aqualitativa e a estratégia metodológica foi a das narrativas psicanalíticas, interpretadas segundo oreferencial winnicottiano. Foi utilizado como mediador da comunicação com as mães o Teste deApercepção Temática Infantil. Os relatos das mulheres brasileiras giraram em torno do processode simbiose e diferenciação entre a díade mãe-bebê, dos recursos empregados para seu manejo eda tarefa da (...) maternidade centralizada na mulher, sendo o pai um colaborador. Os relatos dasfrancesas compartilharam a mesma temática, mas com maior valorização do resgate da própriaautonomia e da do bebê. Além disso, em comparação com as mães brasileiras, a tarefa daeducação da filha foi mais compartilhada por ambos os genitores franceses. (shrink)

In the article, I examine Hélène Cixous's play La Ville parjure ou le Réveil des Erinyes as a political contribution to the debate over memory and justice. The focus is on the question of how the telling of a story of atrocities may be therapeutic to both the victim and to society. I stress Cixous's alternative way of addressing justice: through forgiveness instead of criminal prosecution or other forms of retribution or reconciliation. Referring to Jacques Derrida's work, the main argument (...) revolves around the question of whether forgiveness for unspeakable crimes should be unconditional or conditional. Instead of seeing Cixous's play as an unequivocal stance on restorative justice in general, and on conditional forgiveness in particular, I stress that the main protagonist, the Mother, is not willing to forgive the crime itself because of its unforgivable nature. The aim of this study was to describe how patients’ participation in the care they received was documented in their health care records during the last three months of their lives. Two hundred and twenty-nine deceased adult persons were randomly identified from 12 municipalities in a Swedish county and their records were selected from different health care units. Content analysis was used to analyse the text. Four categories of patient participation were described: refusing offered care and treatments; appealing for relief; (...) desire for everyday life; and making personal decisions. The most common way for these patients to be involved in their care at the end of their life was by refusal of the treatment and care offered. Characteristic of the different ways of participation were the diverse activities represented. The description of patients’ involvement in their life situation at this time indicated their dissociation from the health care offered more than consenting to it. (shrink)
